TERMS & CONDITIONS
PLEASE, READ CAREFULLY THE FOLLOWING INSTRUCTIONS BECAUSE PURCHASING FROM OUR SHOP MEANS YOU ARE ACCEPTING THE FOLLOWING SELLING TERMS AND CONDITIONS:
1) POSTING (RISK OF LOSES): Items purchased from us travels at the buyers’ own risk. According to the current laws and regulations, the seller must only keep proof of posting, and s/he is not responsible in case the mailed item(s) is lost, stolen, or damaged caused during transportation. To avoid such problem, the buyer could ask for, and pay the extra charges, to insure their purchases during transportation.
2) POSTING (WAYS AND TIMING): We post using the Italian postal service (“Poste Italiane”). The packs are ready and posted between 1 and 2 days after payment has been received and cleared in our accounts. If the buyer prefers other courier services, we can discuss and accept it A) Such courier picks up the box from our shop, and B) If the buyer pays the transportation plus the sum of €3 for packaging and packaging expenses.
3) RECEIVING THE OBJECT(S): When the buyer receives the delivery of our items, they must control accurately there are not breaks or damages in the external packing (box, envelops, etc) and that the boxes, envelops, etc are not empty. In case there is any external anomaly or the container is empty, the buyer MUST NOT accept the delivery and point out to the delivering person why: they will have to fill in a report. Failure to follow this shall result in no controversies with us the seller, because there will be no way of pursuing the case with the courier once the package is accepted and the courier leaves.
4) PAYMENT: We gladly accept bank transfer and cash when picking up the object (s) from us if that is the case. Please, contact us for other forms of payment.
5) PAY PAL: Buyers using pay pal as a form of payment must, without exceptions, choose the P & P “Altre spedizioni internazionali” or whatever is the most expensive option offered. This is due to the shipping conditions requested by pay pal to be protected as seller. We will post the item(s) in the way we think will protect our rights as sellers and your right to receive it in the same condition as we sent it. If a buyer pays using pay pal without following this rule, the item(s) will not be send until full payment and full P & P charges are received, or the transaction will be cancelled.
6) INVOICE: Invoicing is mandatory in Italy even for private customers, therefore Italian residents must let us know their Codici fiscali when buying from us. Items shall not be posted to residents in Italy until we have received their Codici fiscali.
7) RIGHT OF RESTITUTION (“RETURNS”): According to article 5 of the DecretoLegislativo number 185/1999 for distance selling the buyer has the right of asking the cancellation of the sale within 7 days and without the need of providing any explanation of why they wish to do so. The buyer must, in these cases, send a letter signed to us, addressed to: The Doctor 61 Motorcycles di Minoldo Antonio, via Giuseppe Verdi, 16 – 36064 Mason Vicentino (VI), Italy. (As proof of date we shall use the tracking data).The letter shall be send within 7 days of the transaction and the buyer must inform the seller via email, to: tony@thedoctor61-motorcycles.co.uk
8) FOR OUR FRIENDS AND CUSTOMER RESIDENTS IN ITALY ONLY
In base al Decreto Legge n°209 del 24 giugno 2003
Second hand brakes (discs and drums) sold by us, are considered parts related to safety, therefore they have to be invoiced to a professional installer (mechanic, etc). It is necessary that the buyer makes the necessary arrangements with their mechanic.
If any of these brakes is bought without providing the installers’ details, the parts are considered as not adapt for use in the road. If they were to be used, The Doctor 61 Motorcycles are not to be held responsible in case of damages to people, animals of things caused by malfunctioning of the afore mentioned parts.
9) RETURNS NOT ACCEPTED: We do not accept returns of any ELECTRICAL and / or ELECTRONIC items. Examples are: ignition control units ignition coils, ignition leads, relays, fuses, fuel injection control units, ABS controls, lamps, “black boxes”, injection chips, on board computers, wiring looms, temperature sensor, speed sensors, gear sensor, clocks, instrument panels, etc). Besides, we do not accept returns for items sold in Auction format.
10) RETURNS WITH EXCHANGE OF ITEM: Returns are accepted a regulated by the Italian and European Union rules of distance selling within certain time limits (10 days, see paragraph 7). In case the return is due to the customer “changing their minds” about purchasing the item(s), posting back charges, and our initial P & P charges shall not be reimbursed. Returns will take place only after the amount dues are returned to us.
11) RETURNS DUE TO OUR ERROR: If we make a mistake sending the buyer the wrong item, or an item showing visible anomalies, or defects NOT DESCRIBED in the ad, we will also reimburse the buyer’s mailing expenses. The buyer, however, has the right to decide to get a voucher for future purchases instead of their money back. Buyers and kindly reminded to let us know ASAP and however NOT beyond the 10 days limit, of errors committed by the seller.
12) RETURNS WITHOUT EXCHANGES (GIVING YOU YOUR MONEY BACK): Only the cost of the item will be returned, whilst the customer’s mailing expenses (and our P & P expenses) shall NOT be reimbursed. Only in the specific case that the return is caused by our mistake (item very different to what was advertised, defects, etc (see paragraph 11).
